WASHINGTON ? Despite strong and widespread concerns from the business community, the National Labor Relations Board (NLRB) has released the new federal workplace poster detailing employees? rights under the National Labor Relations Act to organize unions.

The new 11 x 17-inch poster is available now for downloading on the NLRB website. Posters also can be ordered from an NLRB office.

Failure to post the notice could constitute an ?unfair labor practice? under the National Labor Relations Act. The NLRB says it will not initiate enforcement action on its own for an employer?s failure to post the notice but could investigate cases based on complaints by employees or other parties.

NACS says that the new rule isn't just about unionizing and organizational rights (although it certainly is designed to promote that outcome). In addition to a rather one-sided statement of protections afforded to employees who are or who may wish to be engaged in organizing activities, the Notice speaks to protected concerted activities, alerting employees to protections they have in voicing complaints about terms and conditions of employment.
