AUCKLAND ? Beginning this week, cigarettes sold in New Zealand must be removed from plain sight, as required by the country?s retail display ban, the New Zealand Herald reports. Retailers have also been barred from referring to the sale of tobacco in their names.

The ban was implemented in an effort to prevent young people from smoking, said Associate Health Minister Tariana Turia.

"Retail displays, innocently positioned alongside everyday confectionary and sweets, are a key component of making cigarettes attractive to recruit young smokers. We're not going to tolerate this any longer,? Turia said.

The new law also allows enforcement officers to immediately fine retailers $1,000 for selling tobacco to minors, while increasing the maximum penalty from $2,000 to $10,000.

Last week, Philip Morris began an aggressive fight against New Zealand?s tobacco regulations, saying they go too far. As part of that effort, the company is distributing cards to tobacco retailers directing smokers to a website through which they can have their say on the regulations. It has also established a website that allows the public to show their opposition to the restrictions.

A legal challenge to the law is also working its way through the court system.

It was only later that I read through the part of the agreement releasing Visa and MasterCard from future legal claims by merchants?And this is why the agreement will fail.?

This, coming from former MasterCard executive David True, who is now the president of NYPAY and managing director at Broadly Curious Advisors.

True?s opinion appeared last week in American Banker with the headline: ?Here's Why the Visa/MasterCard Swipe Fee Agreement Will Fail.? He writes that any merchant who has accepted Visa or MasterCard since 2004 ?will be unable to sue regarding interchange, network rules, merchant fees and related issues, even if that merchant has elected not to receive funds from the agreement.? This also includes any merchant who had no involvement in the lawsuit.

?This is flabbergasting, which is why I didn?t grasp it on first reading. I couldn't imagine such broad terms. It also helps me understand the sanguine comments Visa and MasterCard representatives made when the deal was announced and leads to my conclusion that, as merchants understand what the agreement means, more and more will object,? True wrote.

Even the ability for a merchant to surcharge is questionable, notes True, because Visa and MasterCard would be allowed to set a cap, limiting the amount a merchant could surcharge.

True also notes that the proposed settlement ?changes nothing about how interchange is set or the complexity of interchange rates,? and cites a merchant comment from Forbes: ? ?with Visa/MasterCard, the discount fee changes from card to card and the retailer never knows exactly what he is paying until long after the transaction has been completed ? [which] makes it harder to estimate your cost of doing business."

?Transparency has a value; the current Visa/MasterCard system is opaque and the agreement does not address this,? wrote True.

Noting that NACS, Target, Walmart and NGA have all come out in opposition to the proposed antitrust settlement, True believes more will come.

WASHINGTON ? NACS hailed legislation introduced yesterday,�H.R. 6174, the Common Sense Nutrition Disclosure Act, as a thoughtful approach to providing the necessary flexibility and understanding of convenience store foodservice operations.

?This legislation will allow the Food & Drug Administration (FDA) to satisfy Congress?s objectives without unnecessarily burdening most convenience stores,? said Norfolk, Va.-based Miller Oil Co. President Jeff Miller during a Capitol Hill press conference announcing the new legislation.

The bipartisan legislation, introduced by U.S. Representative John Carter (R-TX) codifies a less burdensome approach to menu labeling and includes language addressing the types of retail locations that are covered by federal menu-labeling requirements.

Carter unveiled H.R. 6174�with Reps. Henry Cuellar (D-TX), Tim Walberg (R-MI) and Ruben Hinojosa (D-TX), along with industry representatives from the grocery, convenience store and pizza community.

?The Affordable Care Act was a 2,000 page bill and most House members had no idea it created new federal regulations on pizza toppings and sub sandwiches,? said Carter in a press statement. ?The rules the government now seeks to impose on pizza alone would force these guys to wallpaper their stores with calorie information on every possible combination of toppings, while the majority of their customers order delivery over the phone and never come in ? and that?s crazy?So is trying to force convenience and grocery stores to meet the same labeling requirements as a restaurant. But the threat of fining a business because a teenage employee put two extra slices of pepperoni on a pizza goes from crazy to scary.?

The current health-care law includes a provision that calls for a national, uniform nutrition-disclosure standard for foodservice establishments. Regulations implementing this provision, released in 2011, would create rigid requirements that pose an unreasonable burden on many businesses, particularly convenience stores. The proposed regulations would require chain restaurants, ?similar retail food establishments,? and vending machines with 20 or more locations to provide specific nutritional information, including calorie-counts on menus, menu boards and drive-thru boards. Self-service items such as buffets and salad bars must contain caloric information ?adjacent? to the item. Retailers would have to provide additional nutrition information in writing upon request.

Carter?s legislation limits the provision in Section 4205 of the health-care law to establishments that derive 50% or more of their revenue from food that is intended for immediate consumption or prepared and processed on-site. Prepackaged food would not be considered in this equation. Given that last year 17% of convenience stores? in-store revenue dollars were derived from prepackaged food, according to NACS State of the Industry data, most convenience stores would be exempt under the new legislation.

For those convenience stores that would be covered by federal menu-labeling requirements, the Common Sense Nutrition Disclosure Act provides more flexibility with compliance. Retailers could select from several approaches in providing calorie information. For instance, pizza sellers could provide calories per slice or for the whole pizza. The legislation also would allow retailers more flexibility in providing calorie ranges as opposed to a specific number, which is often more difficult to define with made-to-order food.

?Convenience stores and their food offerings vary greatly ? even those like mine that are part of the same chain ? based largely on their location and customer base. This legislation provides retailers with the flexibility they need to communicate calorie nutrition information. More important, it sets realistic requirements for how businesses are classified under these regulations,? said Miller, who served as the 2010-2011 NACS chairman.

NACS has been actively engaged with the FDA during the regulatory process, ensuring that the agency understands the convenience store industry?s unique perspective on federal nutrition disclosure obligations.

?This legislation would allow FDA to meet the objectives of the menu-labeling law without unnecessarily burdening retailers that rightfully should be outside of its scope,? said Miller.

Most countries outside the U.S. have already converted from magnetic stripe to EMV technology, which uses an embedded microprocessor chip that encrypts account information. The new chip-enabled cards will include the traditional magnetic stripe, which is used by U.S. merchants.

"The new chip-enabled cards will improve convenience and security of customers' transactions when traveling abroad," said consumer and small business products executive Susan Faulkner. "We want our customers to have the best possible experience while making purchases with their credit cards anywhere in the world."

Cards affected include all newly issued Merrill Lynch credit cards, U.S. Trust Accolades, BankAmericard Travel Rewards, BankAmericard Privileges and Virgin Atlantic travel credit cards. The bank also will upgrade existing customers in these card programs who have been identified as international travelers, and the chip will be an optional feature that cardholders can request for the following credit card programs: BankAmericard Cash Rewards, BankAmericard Power Rewards, BankAmericard, AAA Members Rewards, NEA, Asiana Airlines, Alaska Airlines, Hawaiian Airlines, Royal Caribbean and Norwegian Cruise Lines.

Earlier this year, Bank of America began rolling out chip and PIN credit cards to corporate and commercial clients in the U.S., which followed last year's release of chip and PIN cards to corporate and commercial clients in Europe.

ARLINGTON, Va. ? Joining NACS, SIGMA, Target and Walmart, the National Grocers Association announced this week that it too condemns the terms of the proposed antitrust settlement with Visa and MasterCard that was announced on July 13.

?NGA joined the lawsuit on behalf of its independent retail grocer members over seven years ago to bring about real reform of the anticompetitive credit card swipe fee system. This proposed settlement agreement fails in this regard by allowing Visa and MasterCard to continue their dominant anticompetitive practices,? said NGA President and CEO Peter Larkin, in a press release.

?Meanwhile, merchants and consumers will continue to pay exorbitant swipe fees with no hope of reform. NGA?s members are also concerned about Visa and MasterCard?s ability to use their dominance to prevent emerging and innovative lower cost payment options,? he said.

Also lending opposition to the proposed antitrust settlement this week is the Vermont Retail Association. Tasha Wallis, executive director of the group, told the Bennington Banner that the Vermont Retail Association opposes the settlement because it will not prevent card companies and banks from continuing to raise fees in the future.

?As far as small, Vermont retailers are concerned, this settlement doesn?t solve the problem they face, which is the market power the credit card companies have and the amount they can charge. There?s nothing in that proposed settlement that addresses that issue,? she said. ?It doesn?t take the kind of bold steps to address the underlying market issues.?

NACS, a class plaintiff in the litigation, continues to hear from retailers and associations also concerned with the terms of the proposed swipe fee antitrust settlement. Because the proposed settlement does not introduce competition and transparency into the broken credit card swipe fee market, the NACS Board of Directors rejected the proposed settlement agreement. NACS was the first class plaintiff to reject the terms of the proposed agreement, but is hopeful that other class plaintiffs will join NACS and NGA in the coming weeks.

NACS suggests that retailers proceed with caution, especially if they get unsolicited sales calls that offer a cut of the settlement funds.

?There is no need to sign any agreements with third parties to obtain settlement funds. We will provide news and updates on a regular basis related to the terms of this proposed settlement and recommend that retailers do their due diligence in going forward,? said NACS Senior Vice President of Government Relations Lyle Beckwith.

Beckwith also encouraged retailers to express their opinions regarding the terms of the proposed settlement via local media and in press releases: Tell them what you think of the proposed settlement, and that this issue is far from over. The credit card companies want everyone to think that the lawsuit is settled.

NEW YORK CITY ? With more young Americans relocating to cities, big-box retailers are following suit, but at a smaller size, the New York Times reports. With the suburbs filled up, retailers are hoping that small city locations will spur growth.

The shift to smaller sizes marks a change from previous attempts to make big-box formats fit into a city?s smaller footprint. This time around, retailers are paying more attention to city residents to change store sizes, packaging and signage.

?The suburbs are basically saturated with retailers,? said Patrick L. Phillips, chief executive of the Urban Land Institute. ?But it?s easy to develop stores in the suburbs, and hard to develop stores in cities.?

Office Depot is one retailer who redesigned its stores to develop an ?economically defensible? way of opening locations in cities, said Kevin Peters, Office Depot?s president of North America.

City shoppers want to get in and out of a store quickly. Office Depot?s Hoboken, N.J., store has a scant 5,000 square feet with shelves around 6-feet tall. Aisle signs are simple. A service desk that has copiers and package services is large enough to be easily noticed. The store also has about half of a typical Office Depot location, with more emphasis on immediate-replacement items rather than stock-up product packages.

Target?s City Targets opened in Seattle, Los Angeles and Chicago this week. At just about half the size of a revamped location, City Targets carry items aimed more at urban customers than suburban shoppers.

?We see this as an opportunity for the people who live, work and play downtown, who probably have a suburban Target they call their home base,? said Molly Snyder, Target spokesperson. ?You?ll see less 12-packs of paper towels and more four-packs, knowing most people will arrive by foot or public transportation and will have to carry it home.?

Only 160,000 players have registered to buy tickets via the Internet, far below the 600,000 to 1 million expected eventually.

The lottery?s new manager, Northstar Lottery Group LLC, is revising the lottery?s website and will introduce the changes when Powerball is added to the Internet lineup in the fall.

WORTHINGTON, Ohio ? This week in close to 100 cities, federal agents and local police invaded dozens of stores in search of illegal synthetic drugs, such as Spice and K2, USA Today reports. The crackdown is the first since the federal government banned synthetic drugs on July 9. The substances, often labeled bath salts or herbal incense, provide similar highs as LSD, marijuana and cocaine, and had been sold in convenience stores and smoke shops, as well as online.

Prior to the federal ban, numerous states enacted their own bans against the substances. NACS notified its 148,000 member stores to remove the products from their stores when the federal ban took effect, said Jeff Lenard, NACS spokesman.

Mustafa Jamal, who owns a Richmond, Va., Sunoco gas station and convenience store, said he complied immediately with the ban. ?The day it was banned, the entire thing was thrown out of the building,? said Jamal.

Other stores ignored the warning. In Columbus, Ohio, police found the banned substances at three shops and a convenience store. Also targeted were retailers in New York and Tampa, and 12 convenience stores and gas station close to Pittsburgh.

In Duluth, Minn., federal agents raided Last Place on Earth, a store suspected of selling the drugs. ?For the last 16 months, problems with synthetic drugs and the behaviors around the Last Place on Earth downtown has been a major concern for our citizens, business community and the police department,? said the Duluth Police in a written statement.

ANNAPOLIS ? Add Maryland to the list of states enjoying a record-setting year for lottery sales, the Baltimore Sun reports.

For the 15th consecutive year, the Maryland Lottery reported an increase in ticket sales, with $1.795 billion recorded during fiscal 2012 ? $80.4 million more than the prior year. As a result, the state earned $556 million, 7% more than last year.

"The record and sales increase is a culmination of a lot of different things," said Stephen Martino, the Maryland Lottery's director.

The biggest reason, Martino said, is the diversity of options now available as well as the strength of the Lottery?s retail network.

Gains were recorded across all game segments; no single game comprises more than a third of the lottery?s revenue.

Monitor games contributed the largest share of sales, with roughly 29%, or $521.7 million in sales volume.

The new law also allows enforcement officers to immediately fine retailers $1,000 for selling tobacco to minors, while increasing the maximum penalty from $2,000 to $10,000.

Last week, Philip Morris began an aggressive fight against New Zealand?s tobacco regulations, saying they go too far. As part of that effort, the company is distributing cards to tobacco retailers directing smokers to a website through which they can have their say on the regulations. It has also established a website that allows the public to show their opposition to the restrictions.

A legal challenge to the law is also working its way through the court system.
